If you use the trust in this program and your spouse dies before you, you do not need to do a new trust.
You do not need to refund or change the title on assets because they're already held in the name of the existing trust.
You may want to remove your spouse as a trustee from the account so that you are shown as the sole trustee on the accounts.
You may also change the terms of the trust if you want to, by doing a restatement of the trust.
So if you want to change who receives assets after your death, who would act as your successor trustee, who would determine your incapacity. You can do that without creating a completely new trust.
If however, you are willing to go the extra mile and you do not want to have your deceased spouse's name remain as the title on the trust, you can create a new trust, that's simply in your own name. If you do that though, you have to go and refund and retitle all of the assets into the new trust name.
The documents that are available to you under this program would allow you to restate the trust after your spouse has died, if you created the original trust with the program.
If you want to create your own trust, you can also do that using the program, you would simply select under the profile "single trust."
