The "Gift of Personal Property" section has been moved from the Will into the Trust document. This change reflects a more streamlined and legally efficient way to distribute personal property, which is often best handled through a Trust to avoid probate and provide greater flexibility.
What Should You Do Now?
If you are updating your Will, we recommend that you also update (or “restate”) your Trust at the same time. This ensures:
Your personal property gifts are properly documented in your Trust.
Your estate plan remains consistent and legally sound.
You avoid potential confusion for your heirs or legal representatives later.
Updating both documents together keeps your entire estate plan aligned with the latest structure and best practices in the Must Have Documents.
How to Do a Trust Restatement
Log in to your Must Have Documents account.
Go to your Trust document.
Select the option to "Continue".
Follow the prompts to include your Gift of Personal Property selections.
Select to print Restatement of Trust
If you have already updated your Will but haven’t updated your Trust yet, we strongly encourage you to go back and complete the Trust restatement for a fully updated and comprehensive estate plan.
