What Is a Married Trust and Why It Includes Both Spouses
When you select the Married Trust option during the Must Have Documents process, the trust is designed to include both you and your spouse from the start. Here's how it works:
You are both co-creators (grantors) of the trust.
You are both co-trustees, which means you manage the trust together while you're alive and able.
You are both primary beneficiaries, meaning the assets in the trust are for both of your benefit during your lifetimes.
Because of this, there is no need to manually add your spouse as a beneficiary—they are already built into the structure of the Married Trust.
Documents Where Your Spouse Is Included in a Married Trust:
Revocable Living Trust (both as grantors, trustees, and beneficiaries)
Will (each of you names the other as your main beneficiary)
Power of Attorney (each of you assigns authority)
Healthcare Directive (each of you names the other for medical decisions, if desired)
