The majority of states have tried to prevent a pregnant woman or a pregnant woman with a viable fetus from having her power of attorney honored. These states include Alabama, Alaska, Arizona, Arkansas, Colorado, Connecticut, Delaware, Florida, Georgia, Idaho, Illinois, Indiana, Kansas, Kentucky, Maryland, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, South Dakota, Texas, Utah, Vermont, Washington, and Wisconsin.
If this is of concern to you then you can add the following language to your power of attorney: "I have the right not to be exposed to increased medical risks for the sake of my fetus, and the state's interest in the potential life of the fetus is insufficient to override my interest in preserving my own health. My agent shall have the authority to withhold treatment for me even if I am pregnant."
To edit your order of protection option:
1. Click on 'Your Info' at the top left of the program and scroll down to select 'You - Make Changes'.
2. Scroll down and select Order of Protection - Make Changes.
3. You will be able to select if you you want the order of protection language to be added your power of attorney document.
